La réception provisoire prend effet

La réception provisoire prend effet à la date d’achèvement des travaux de réception et après signature des PV des essais optiques des deux sens.
La réception provisoire partielle n’est pas prévue.

1 Article 42. Garanties contractuelles
Le délai de garantie est fixé à un (1) an à compter de la réception provisoire.

1 Article 43 Réception définitive
A l'expiration de la période de garantie d’une année, la réception définitive pourra être prononcée à la demande du Contractant, sous réserve que ce dernier ait bien remédié aux défauts de fonctionnement, anomalies, désordres ou malfaçons constatés pendant le délai de garantie.
Cette réception définitive sera différée pour les parties qui auraient subi des remplacements ou ayant fait l'objet de garanties supplémentaires acceptées, par les deux parties
La réception définitive marquera la fin d'exécution de l’engagement et libérera les parties contractantes de leurs obligations.
La réception définitive partielle n’est pas prévue.

1 Article 44 - Caractère des prix - Sous-détail des prix
Le montant de la fourniture importée devra être exprimé en devise CIF, Port de Casablanca, Incoterms 2010 de la Chambre de Commerce Internationale, selon le bordereau des prix de l’appel d’offres.
La part en MAD doit comprendre les frais d’approche (Droits de douane et taxes connexes, assurance, transit, frais portuaires, transport jusqu’au site…) qui sont à la charge du contractant
1 Article 45 - Impôts et taxes
Il reste entendu que l’entrepreneur fera son affaire de l'importation et du dédouanement de toutes les fournitures et équipements nécessaires à la réalisation des ouvrages du présent marché ainsi que le matériel devant constituer son propre stock pour faire face à ses obligations contractuelles.
Pour toutes les fournitures et équipements importés nécessaires à la réalisation des ouvrages du présent marché, dont le montant est payable en devises étrangères, l’entrepreneur ou son transitaire se chargera de toutes les démarches et de toutes les opérations de dédouanement, déchargement à quai, transit, enlèvement, livraison sur site, etc...
A cet effet, il doit, avant toute expédition, arrêter avec le maître d'œuvre la liste du matériel à importer.
Pour permettre à l'ONEE-– Branche Electricité de suivre l'évolution des opérations d'importation l’entrepreneur est tenu à l'occasion de la réalisation de chacune de ces opérations, de constituer un dossier approprié à mettre à la disposition de l'ONEE– Branche Electricitéaux Bureaux de la Direction Approvisionnements et Marchés
